INFORMATION WE COLLECT 

1.1.

When a User merely browses our Website (hereinafter “Browsing User”) without interacting via Website, registering/signing-in/logging in the Platform, or communicating via the Website, we may collect the following information of the user.

1.1.1.

IP Address: This is a unique numerical label assigned to a device connected to a computer network that uses the Internet Protocol for communication, identifying both the host and its location on the network.

1.1.2.

Device Information: Details about the user’s device, including the operating system, browser type and their version; screen resolution and hardware model.

1.1.3.

Cookies: These are small text files stored on the User’s device that can track browsing activities. Cookies can be session-based (deleted after the session ends) or persistent (stored for a longer duration).

1.1.4.

Browser Metadata: Information such as language preference, time zone settings, and browser plugins. 

1.1.5.

Referrer Data: The URL of the previous website visited by the User before arriving at the current site, which had referred the User to the Website.

Page Views and Navigation: Information about the pages viewed, the time spent on each page, and click patterns within the website.

Session Data: Information regarding the User’s interaction with the Website during the browsing session, including duration of browsing, user preferences, scroll patterns, mouse movements, and how the user navigates between different pages.

We collect personal information when you (hereinafter “Platform User”) interact or communicate via the Website or register in/sign-in/login the Platform and interact with our Platform to avail Services (i.e., offerings that User can avail from Platform after procuring License via Master Licensing Agreement or under End-User License Agreement). This includes, but is not limited to:

Identifiers: Such as your name, email address, phone number, IP Address, and postal address to manage your account and provide our Platform Services. 

1.2.2.

Employment-related information: Job titles and company names that you provide when engaging with our Services if you are representing on behalf of another entity. 

1.2.3.

Account information: If you create an account on Arivonix, we collect your Access Credentials (As defined under Master License Agreement/End-User License Agreement); and other necessary authentication details.

1.2.4.

Customer service and interaction information: This includes the information you provide when you interact with our support team, request information about Arivonix’s Platform Services, or participate in surveys, feedback sessions, and marketing activities. We keep records of your communications with us. 

1.2.5.

Commercial and transaction information: We maintain records of your transactions with us, such as when you sign up for Licensing Package under Master Licensing Agreement or you have signed up for subscription plan under Subscription Agreement or makes a purchase on our Website. 

1.2.6.

Financial information: When you choose a payment method for procuring License under Master Licensing Agreement, we collect your payment details, such as credit card information, through our secure third-party payment providers. We do not procure your payment details when you choose a payment to be made under Subscription Agreement with End-Customer.

1.2.7.

Information We Collect Automatically: We use standard automated data collection tools such as cookies, web beacons, tracking pixels, and tags to collect information when you use our website:

Device and connection information: We collect data about your computer or device, such as the operating system, IP address, device identifiers, and browser language, to understand how you use our Website and to provide the most seamless experience.

Usage data: Information such as the pages you access on our website, the time spent on specific features, your search queries, and files you interact with. This helps us enhance your experience and improve our platform Services.

Browsing Information: As well, we procure information provided under clause 1.1.

Information from Third-Party Sources: Arivonix may receive information about you from third-party sources, such as:

Business partners and resellers: Information like your name, contact information, and details of your interactions with our Services may be obtained from our partners. 

1.3.2.

Publicly available information: We may also collect data from publicly available sources, such as social media platforms, to ensure accurate and updated information. 

1.3.3.

Third-party integrations: If you choose to integrate third-party services with Arivonix, we may collect and store information from those services, such as your name and email address, as permitted by the third-party service. 

1.4.

Information from Big Data: Arivonix may temporarily receive and store Big Data that may include including Sensitive Personal Data, Nonsensitive Personal Data, or Nonpersonal data, either owned by Customer or Customer having usage rights over the same. 
This combination of collected data helps us to deliver more personalized experiences, offer more effective services, and maintain Website security. 

2.

PURPOSE AND USE OF THE INFORMATION WE COLLECT

2.1.

We use personal information collected via the Arivonix website, our Services, and through other interactions for various purposes, including: 

2.1.1.

Service Delivery: To facilitate the delivery of our Services via either Master License Agreement or via End-User License Agreement, such as providing the Platform to create Data Product and/or Subscription Product, or in providing the Platform for you to undertake data analytics/data engineering/or data science using Analytical Tools. 

2.1.2.

Operating and Improving Our Website and Services: To manage, audit, and enhance the functionality and performance of the Arivonix Website/Platform, ensuring our Services meet Customer/End-Customer needs effectively. 

2.1.3.

Customer Support: To provide Customer/End-Customer service and support, including addressing your queries and resolving any issues you face while using Arivonix Services. 

2.1.4.

Communication: To send you important information related to the Services you have subscribed to, such as confirmations, invoices, technical notices, updates, security alerts, and administrative messages. We also use this information to provide you with training and support related to the Arivonix Website/Platform.

2.1.5.

Account Management: To create, maintain, and manage your Arivonix account procured via Master Licensing Agreement, including updating your Access Credentials as per your Package. 

2.1.6.

Security and Fraud Prevention: To enhance the security of our Website/Platform, monitor and verify User identity, prevent unauthorized access, and combat fraud, spam, malware, and other network or data security risks. 

2.1.7.

Error Detection and Quality Control: To detect bugs, report errors, and perform ongoing activities to maintain the quality, safety, and performance of our Website/Platform and Services. 

2.1.8.

Research and Development: To conduct research and development aimed at improving our analysis tools, enhancing Service offerings, and creating new products that better serve customers’/end-customers’ needs. 

2.1.9.

Personalization and User Preferences: To understand your preferences and personalize your experience with the Arivonix Website, including tailoring recommendations and content to enhance your engagement with our Services. 

2.1.10.

Marketing and Promotions: To develop and send you relevant marketing communications, including online advertising, sales offers, and promotional content. We also communicate about events such as webinars, training sessions, and partner events, in accordance with your marketing preferences. 

2.1.11.

Feedback and Surveys: To reach out to you for customer surveys, gather feedback on our products and Services, conduct audits, and assess usage trends to improve your experience on the Arivonix Website/Platform. 

2.1.12.

Data Aggregation and Analytics: To generate, analyze, and use aggregated data insights to optimize Arivonix’s Website/Platform, track engagement, and measure the effectiveness of our marketing campaigns. This may involve combining your personal information with other data to improve our services and understand market trends. 

2.1.13.

Legal Compliance: To comply with our legal obligations, ensure adherence to data protection regulations, and maintain our Services in accordance with applicable laws and regulatory requirements.

Fraud Prevention and Security Investigations: To investigate potential security issues, monitor compliance with applicable laws, prevent fraud, and ensure that the Arivonix Website/Platform is not being misused.

De-identified and Anonymized Information: Arivonix may anonymize or de-identify personal information so that it cannot reasonably identify you or your device. Once anonymized, this information is no longer subject to any restrictions and may be used or disclosed for any legitimate business purpose.

Other Legitimate Business Purposes: We may use your personal information for legitimate business purposes, including conducting data analysis, customer surveys, improving marketing strategies, and enhancing customer relationships. 

2.1.17.

With Your Consent: We may also use your personal information for additional purposes where you have provided explicit consent, such as for targeted marketing or sharing information with our partners.

2.1.18.

For Customer to Process Big Data: For providing Services to Customer who has Local Storage Systems, Big Data specified in Clause 1.4 would be copied in the Platform’s cache memory at the Customer-specific page in the encrypted format temporarily until creation of the Data Product and Subscribed Product in the Local Storage Systems; and also for End-Customer to use Analytical Tools on the Subscribed Product, wherein the Subscribed Product may be required to be copied to the Platform’s cache memory at the Customer-specific user page in the encrypted format temporarily. There are no rights for disclosure, sharing, or storing Big Data except for the purpose specified in this sub-clause. The specifics pertaining to Data Processing are covered under Data Processing Agreement entered into between Arivonix and Customer.

3.

DISCLOSURE OF INFORMATION

3.1.

We do not disclose your personal information to third parties except as follows: 

3.1.1.

At Your Direction: When you instruct us to do so, we will disclose your personal information as per your direction. 

3.1.2.

With Your Consent: With your explicit consent, we may disclose your personal information to third parties, such as our business partners, for their own marketing purposes, subject to their own privacy policies. 

3.1.3.

Affiliates: We may share your personal information with our affiliates or subsidiaries. In such cases, your information will be processed according to the terms of this Privacy Policy.

3.1.4.

Service Providers: We may share your personal information with third-party vendors, consultants, and other service providers under written agreements that require them to protect your personal information. These service providers assist us in providing services like billing, payment processing, data analysis, fraud prevention, network and information security, technical support, and customer service. 

3.1.5.

Marketplace Providers: If Arivonix hosts a marketplace for third-party products opted by you, we may share your personal information with providers offering products on the marketplace to facilitate transactions or fulfill product and information requests. With your consent, these providers may send you marketing communications about their other offerings on the marketplace. 

3.1.6.

Legal and Regulatory Compliance: We may disclose personal information when required to comply with applicable laws, legal processes, or government regulations, or when we believe it is necessary to protect the rights, property, and safety of Arivonix, our users, or the public.

Security and Fraud Prevention: We may disclose personal information to protect against unauthorized access, investigate security incidents, prevent fraud, and address illegal or malicious activities that affect our website and services.

Vital Interests: We may disclose personal information if we believe it is necessary to protect someone’s vital interests, such as in situations involving the risk of harm or injury.

Business Transactions: In connection with any potential or actual merger, acquisition, financing, sale, or transfer of all or a portion of our business or assets, we may disclose your personal information to relevant parties involved in the transaction. Should a transfer occur, your personal information will be handled in accordance with this Privacy Policy, unless otherwise notified.

De-identified or Anonymized Information: We may disclose personal information that has been de-identified or anonymized, including through aggregation, such that it no longer identifies you or your device or Customer Data/End-Customer Data. 

3.1.11.

Arivonix does not knowingly sell or disclose the personal information of individuals under the age of 18. 

3.1.12.

Arivonix does not disclose Big Data, Tabulated Data, Data Product, or Subscription Product to anybody except to provide Services under Master Services Agreement or End-User License Agreement as detailed under Data Processing Agreement. 

4.

YOUR CHOICES AND RIGHTS 

4.1.

We provide You with choices regarding the collection, use, and disclosure of your personal information, and we respect the decisions you make, in compliance with applicable laws. Please note that if you choose not to provide certain personal information, you may not be able to access specific features of our Website, Platform, and Services.

Account Information and Privacy Rights- You may have certain rights regarding your personal information, including:

Requesting a Copy of Your Information: You may request a copy of the personal information we hold about you, or request that we correct, update, or delete any inaccuracies in your information.

No Discrimination: Arivonix does not discriminate against you for exercising your privacy rights and does not offer financial incentives related to the use of your personal information.

Opt-Out of Marketing 

4.5.1.

We may send you marketing communications about our Services. You can opt out of these communications at any time by following the unsubscribe instructions in the message or by visiting unsubscribe link shared along with such communication. It may take some time to process your request, but we will ensure that you no longer receive marketing communications. However, you may still receive Service-related communications, such as updates about your account or security notifications.

4.7.

Notice of Right to Opt-Out of Data “Sales” and “Targeted Advertising”

4.7.1.

Depending on your location, you may have the right to opt out of the “sale” of your personal information or the disclosure of your information for online targeted advertising. Arivonix does not “sell” personal information for monetary payment, but because certain definitions under Applicable Law may classify specific disclosures as “sales,” we offer the right to opt out of such activities. 

5.

INTERNATIONAL TRANSFER OF INFORMATION

5.1.

We collect information globally and may transfer, process, and store your information outside of your country of residence to where we or our third-party service providers operate to provide the Arivonix Platform and Services. Whenever we transfer your information, we take steps to protect it, ensuring it is handled with the highest levels of security and privacy.

5.2.

International Transfers within Arivonix Companies

5.2.1.

To facilitate our global operations, we may transfer information globally and allow access to that information from countries in which Arivonix or its subsidiaries and affiliates operate. These countries may not have equivalent privacy and data protection laws to those where our users and customers are based. When transferring personal data, we rely on mechanisms such as the Standard Contractual Clauses (SCCs) or other legally recognized safeguards to ensure the adequate protection of your personal data. 

5.3.

International Transfers to Third Parties 

5.3.1.

Some of the third-party service providers we use are based in other countries that may not have equivalent privacy and data protection laws. When transferring data to third parties outside the EEA, UK, Asia, or Switzerland, we ensure that such transfers are protected by suitable legal mechanisms such as Standard Contractual Clauses, binding corporate rules, or other legal measures to safeguard the transfer of your personal data.

DATA PRIVACY FRAMEWORK NOTICE 

6.1.

Arivonix complies with Applicable Law involving international data transfer mechanisms for personal data transferred between countries. If there is any conflict between this privacy policy and the Applicable Law Principles, the Applicable Law principles shall govern. Arivonix is committed to ensuring that when personal information is transferred, it remains secure and processed in accordance with this policy and applicable regulations.

In case of any complaints related to Arivonix’s adherence to international data transfer frameworks, please contact us directly. If unresolved, you may engage with relevant third-party dispute resolution services, as well as applicable data protection authorities.

Arivonix Corporation is subject to the investigatory and enforcement powers of the relevant regulatory authorities, including the U.S. Federal Trade Commission (FTC), with respect to our handling of personal data under these frameworks. 

7.

DATA RETENTION AND DELETION 

7.1.

We retain personal information collected from you for as long as we have an ongoing legitimate business need to do so (for example, to comply with Applicable Law, legal, tax, or accounting requirements, to enforce agreements, or to meet other legal obligations). When determining the appropriate retention period for specific categories of personal information, we take into account the nature of the data, the purpose for its collection, and its sensitivity.

7.2.

When we no longer have an ongoing legitimate business need to retain your personal information, we will either delete or anonymize it. If deletion is not possible due to technical constraints (such as being stored in backup archives), we will securely store the personal information and isolate it from any further processing until it can be deleted. 

7.3.

For Customer Data/End-Customer Data processed on behalf of our Customers/End-Customers, we will retain such content as outlined in our Master License Agreement with the Customer/End-User License Agreement. 

8.

USE OF COOKIE AND TRACKING TECHNOLOGY

8.1.

When you use our Website or the Arivonix Platform, we and our service providers utilize cookies and other mechanisms to track information about your usage, navigation, and access. This data is stored in log files. We, or our service providers, may combine this automatically collected log information with other personal information we collect about you. This helps us improve the Services we offer, enhance marketing efforts, perform analytics, and optimize the overall functionality and user experience of the Arivonix Website/Platform.

Arivonix or our Service providers may use cookies to analyze trends, administer the Website/Platform, track user activity (including web pages viewed and time spent on our Website/Platform), and recognize users upon revisiting the Website/Platform. 8.8.1.

We partner with third-party ad networks to serve advertisements on the Arivonix Website and third-party websites. This allows us and these third parties to deliver targeted advertisements that might interest you. Third-party ad networks may use cookies, JavaScript, web beacons (including Clear GIFs), and other tracking technologies to measure ad effectiveness and personalize ads. These technologies are governed by each third-party’s privacy policy, not Arivonix’s.

Opting out through DAA or NAI does not mean you will no longer receive any advertising, only that the ads will no longer be interest-based. If your browser is configured to reject cookies, your opt-out may not be effective. 

8.8.4.

9.

DATA STORAGE

9.1.

Company collects and stores User data in Amazon AWS, Microsoft Azure, Google Cloud Platform cloud till the time the User uses the Services and it will retain the data for as long as necessary to fulfil the purposes for which it was obtained. Processed and non-identifiable data, if accessible, will be perpetually stored. Other heuristic data may be stored which may be identifiable data in cookies.

10.

SECURITY MEASURES 

10.1.

Arivonix has implemented reasonable security measures and safeguards to protect your privacy and personal information from loss, misuse, unauthorized access, disclosure, destruction, and alteration, in compliance with applicable laws. Whenever you change or access your account on the Arivonix Website/Platform or make any modifications to the information related to your account, we provide the use of a secure third-party server for this purpose. However, we cannot guarantee the security of any information you transmit to Arivonix, nor can we ensure that your personal information or other data provided for accessing the Arivonix Website/Platform will never be accessed, disclosed, altered, or destroyed by a breach of any of our security measures.

10.2.

Additionally, it is your responsibility to take appropriate physical, managerial, and technical safeguards to protect the integrity and security of your data, including personal information, when accessing and using the Arivonix Website/Platform. For instance, when payment information is transmitted through the Website/Platform, it will be encrypted for security.  However, we cannot guarantee that transmissions of your payment information or personal data will always be secure or that unauthorized third parties will never be able to breach the security measures we or our third-party service providers have in place.

10.3.

You expressly consent to the sharing of your information with third-party service providers, including payment gateways, for the purpose of processing payments and managing payment-related information. Nevertheless, the Company assumes no responsibility for the disclosure of your information due to transmission errors, unauthorized third-party access, or causes beyond its control.

It is important to note that you play a key role in maintaining the security of your personal information. You should not share your Access Credentials or personal security information with anyone. Although Arivonix has taken reasonable measures to protect your privacy while using our Website/Platform, we are not liable for any unauthorized or unlawful disclosures of your personal information made by third parties that are not under our control.

Arivonix has appointed a Grievance Officer/Data Protection Officer (DPO) to handle complaints relating to privacy concerns.
